no checkbox Disclaimer

hi, great ajax plugin  ;D , but i got 2 problems how do i add a custum messages in the top? and there is no checkbox for Disclaimer, only clickable "I Accept" even when in settings "Display Disclaimer Checkbox" is set to yes.  How to fix this?

There should be acheckbox, maybe your template or JS hides it. What's your URL?
